You agree not to use the Trending Neurons Sites in any jurisdiction or manner prohibited by applicable laws, restrictions, or regulations, including but not limited to those related to:
● AI regulation
● Financial advisory services
● Consumer protection
● Data sovereignty
If you are accessing the Sites on behalf of a business or institution (such as a hedge fund or financial advisory firm), it is your responsibility to ensure your use of the platform complies with applicable legal, regulatory, and internal governance policies.
Indemnification
You agree to indemnify, defend and hold harmless TrendingNeurons, its officers, directors, employees, agents and third parties, for anylosses, costs, liabilities and expenses (including reasonable attorney's fees)relating to or arising out of your use of or inability to use the Site orservices, any user postings made by you, your violation of any terms of thisAgreement or your violation of any rights of a third party, or your violationof any applicable laws, rules or regulations. Trending Neurons reserves theright, at its own cost, to assume the exclusive defense and control of anymatter otherwise subject to indemnification by you, in which event you willfully cooperate with Trending Neurons in asserting any available defenses.
Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions — including the formation, interpretation, breach, termination, enforcement, or validity thereof — shall be resolved by final and binding arbitration.
This arbitration shall:
● Be governed by the Federal Arbitration Act (FAA);
● Be administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules;
● Be conducted by a single, neutral arbitrator;
● Take place in Delaware, USA, unless the parties mutually agree to an alternative location;
● Be interpreted in accordance with the laws of the State of Delaware, excluding its conflict of laws principles.
The arbitrator shall have the authority to award all available remedies under law or equity, including injunctive relief, damages, and legal fees. Judgment upon the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
Waiver of Class Actions and Jury Trials
To the fullest extent permitted by applicable law:
● You and Trending Neurons waive any right to a trial by jury in any legal proceeding arising out of or relating to these Terms or the use of the Services.
● You further agree not to participate in any class action, class arbitration, or representative action against Trending Neurons, whether as a class representative or member.
● All claims must be brought on an individual basis, and not consolidated with any other proceedings.
This provision shall survive termination of your relationship with Trending Neurons.
